Please read these Terms carefully. They include important provisions about beta software, subscription billing, AI-generated content, acceptable use, and limitations on our liability.
01Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you ("you", "User") and HEXIUM AI ("HEXIUM", "we", "us"). By creating an account, accessing, or using the HEXIUM platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you individually and that organization.
02Beta Software Notice
HEXIUM AI is currently in beta. Features may change, services may be interrupted, and users acknowledge they use the platform at their own risk. Beta features may produce inaccurate, incomplete, or unexpected results, and may be modified or discontinued at any time without notice.
We recommend you review and validate all AI-generated outputs before relying on them for any commercial, legal, financial, or operational decision.
03Use at Your Own Risk
You are solely responsible for your use of the platform, the configuration of AI agents you deploy, the content they generate, and the decisions you make based on their output. HEXIUM does not warrant the accuracy, reliability, or fitness for any purpose of AI-generated content.
04Account Registration
To access the platform, you must register an account using accurate, current information and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- You must be at least 16 years old to use the service.
- One person or legal entity may not maintain more than one free account.
- Notify us immediately of any unauthorized access at security@hexorium.io.
05Subscription Plans and Billing
HEXIUM offers paid subscription plans (including HEXIUM Pro, HEXIUM Business, and HEXIUM Enterprise) billed monthly or annually through Stripe. By subscribing, you authorize us to charge the applicable fee to your selected payment method on a recurring basis until you cancel.
- Subscriptions renew automatically at the end of each billing cycle.
- Prices are exclusive of applicable taxes unless stated otherwise.
- You may cancel at any time from your billing portal. Cancellation takes effect at the end of the current billing period.
- We may change subscription pricing with at least 30 days' notice prior to the next renewal.
06AI Credits and Credit Packs
The platform uses AI credits to meter agent activity, generations, and integrations. Subscription plans include a monthly allowance of credits that resets on each billing cycle. Additional one-time credit packs (5,000 / 25,000 / 100,000) may be purchased.
- Plan credits expire at the end of each billing cycle and do not roll over.
- One-time credit packs do not expire while your account remains in good standing.
- Credits are not redeemable for cash, are non-transferable, and have no monetary value outside the platform.
07Refund Policy Reference
Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference.
08User Content
You retain ownership of the content, prompts, data, and materials you submit to the platform ("User Content"). You grant HEXIUM a worldwide, non-exclusive, royalty-free license to host, process, and transmit User Content solely to operate and improve the service.
You represent that you have all necessary rights to your User Content and that it does not infringe any third-party rights or violate any law.
09AI-Generated Content Disclaimer
Output produced by AI agents ("AI Output") is generated by probabilistic models and may be incorrect, biased, or misleading. HEXIUM makes no representation that AI Output is accurate, lawful, original, or suitable for any particular use.
You are responsible for reviewing AI Output before publishing, distributing, or acting on it. Do not use AI Output to provide medical, legal, financial, or other professional advice without independent human review.
10Acceptable Use Policy
You agree not to use the platform to:
- Violate any law or third-party right, including intellectual property and privacy rights.
- Generate or distribute malware, phishing content, or other harmful code.
- Produce content that sexually exploits minors, incites violence, or promotes hate.
- Attempt to reverse-engineer, scrape, or circumvent rate limits and security controls.
- Resell or sublicense the service without our prior written consent.
- Use AI agents to send unsolicited bulk communications, conduct fraud, or impersonate others.
We may suspend or terminate accounts that violate this policy.
11Intellectual Property
The HEXIUM platform, including all software, agents, designs, logos, and documentation, is owned by HEXIUM and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the service for your internal business purposes.
Subject to any third-party model provider terms, you own the AI Output generated for you, except for content that is generic, non-original, or substantially similar to output produced for other users.
12Team Collaboration Features
If you invite team members, you are responsible for their use of the platform and for ensuring they comply with these Terms. The account owner controls billing, roles, and access permissions, and is liable for all activity within the workspace.
13Third-Party Services
HEXIUM relies on third-party providers to deliver the service, including (without limitation):
- Stripe — payments and subscription billing.
- Supabase — managed database, authentication, and storage.
- OpenAI, Anthropic, Google, and other model providers — AI inference.
- Cloudflare — edge runtime and content delivery.
- Lovable — application hosting and deployment.
Your use of integrated third-party services is governed by their own terms and privacy policies. We are not responsible for third-party service outages or modifications.
14Limitation of Liability
To the maximum extent permitted by law, HEXIUM, its affiliates, and its suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with the service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid HEXIUM in the twelve months preceding the claim, or (b) USD $100.
15Disclaimer of Warranties
The service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the service will be error-free or that AI Output will meet your expectations.
16Service Availability
We aim for high availability but do not guarantee uninterrupted service. The platform may be temporarily unavailable for scheduled maintenance, model provider outages, or force-majeure events. During beta, downtime credits do not apply.
17Account Suspension and Termination
We may suspend or terminate your account if you breach these Terms, fail to pay fees, or pose a security or legal risk to HEXIUM or other users. You may terminate your account at any time from your settings.
Upon termination, your right to use the service ends immediately. Sections that by their nature should survive (including ownership, disclaimers, liability limits, and governing law) survive termination.
18Indemnification
You agree to defend, indemnify, and hold harmless HEXIUM, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the service, your User Content, or your breach of these Terms.
19Governing Law
These Terms are governed by the laws of the jurisdiction in which HEXIUM is incorporated, excluding its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute that is not subject to mandatory arbitration or small-claims procedures.
